Mainstream Tinting

By accessing and using the website of Mainstream Tinting (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions of Service ("Terms"). These Terms govern your use of the website and the process of requesting service quotes.
Mainstream Tinting provides window film installation services. The following terms apply to our engagement process:
The client is responsible for ensuring the work area is safe, clear, and accessible for Mainstream Tinting personnel and equipment prior to the scheduled service time. This includes, but is not limited to, removing all furniture, décor, and personal belongings immediately adjacent to the windows to be treated. Failure to provide adequate access or a safe environment may result in delays, rescheduling, or additional service fees, as outlined in the Service Agreement.
Any service appointment scheduled after a final quote is accepted may be subject to a cancellation or rescheduling fee as defined in the final Service Agreement. Mainstream Tinting reserves the right to cancel or reschedule appointments due to circumstances outside of its control, including but not limited to weather, staff illness, or equipment failure.
As Mainstream Tinting provides an on-site custom installation service, returns and refunds are governed exclusively by the Virginia Consumer Protection Act (VCPA) and the specific, final Service Agreement executed between the client and Mainstream Tinting. Any disputes regarding work quality or claims must first be submitted to Mainstream Tinting in writing as outlined in the Service Agreement to allow for cure or mediation. Unless otherwise noted in the final Service Agreement, deposits are non-refundable once the film order has been placed.

By submitting a quote request, you consent to receive electronic communications from Mainstream Tinting regarding your quote, service scheduling, and related follow-up or promotional offers. All promotional emails will include a clear mechanism to opt out of future communications.
The client agrees to maintain a safe and non-hostile environment for Mainstream Tinting personnel while on their property. This includes ensuring that no individual at the service location is under the influence of drugs or alcohol or engages in harassing, discriminatory, or threatening behavior. Mainstream Tinting reserves the absolute right to immediately cease work and leave the property if any employee feels their safety is compromised, or if they observe illegal activity or substance abuse on site. In such an event, the client may remain responsible for services rendered and travel fees incurred up to that point.
The client acknowledges that window film installation is a physical process. While Mainstream Tinting takes all reasonable precautions, the client agrees to hold the company harmless for minor, inherent risks associated with on-site work, such as minor scratches to window frames or minor residual debris, where such damage is not a result of gross negligence.
The website's Content (text, images, logos) is the exclusive property of Mainstream Tinting.
The client hereby grants Mainstream Tinting the non-exclusive, royalty-free, perpetual right to photograph and video the completed service work. This includes images of residential and commercial properties, visible branding, company logos, signage, and custom film details (like phone numbers), for use in promotional, marketing, portfolio, and advertising materials, including on the website and social media. While we reserve this right, the client’s specific street address or private identity will not be published without further written consent, and any sensitive commercial imagery will be used at Mainstream Tinting's discretion.
Mainstream Tinting shall not be liable for any failure or delay in performance under this Agreement due to causes beyond its reasonable control, including, but not limited to, acts of God, war, acts of terrorism, fires, floods, extreme weather, strikes, failure of third-party suppliers, or government restrictions.
The information, content, and materials available on the Mainstream Tinting website are for general informational purposes only.
The website and all Content are provided on an "AS IS" and "AS AVAILABLE" basis.
You agree to defend, indemnify, and hold harmless Mainstream Tinting, its owners, employees, and agents, from and against any and all claims, damages, liabilities, costs, or debt arising from:
These Terms shall be governed and construed in accordance with the laws of the State of Virginia, without regard to its conflict of law provisions.
Any controversy or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. This means you and Mainstream Tinting waive the right to a trial by jury for covered disputes.
You agree that all claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will update the "Effective Date" at the top of this page when we do so. By continuing to use our website after any such modifications, you agree to be bound by the revised Terms.
